In looking at legislation with regard to “How do I convince my boss” I ran across proposed TN legislation by Senator Bo Watson. SB 469. Senator Watson is my senator and I gave him information from the AED legal center and requested a meeting in late Jan. What he has proposed did address my main concern of business not placing AEDs because of training requirements such as banks, movie theaters, restaurants and office buildings. All situations where there may be few or no employees making previous legislation difficult meet with regard to training requirements.

What he also included are the most dangerous words regarding public safety and the cause for placing more AEDs I have ever seen.

Section 68-140-707 part c reads:

(c) A facility which does not provide an AED shall not be liable to persons who suffer cardiac arrest or sudden cardiac death in or near the facility.

In short having an AED exposes the organization to training people, maintaining the unit, having it available, having medical oversight and other things to be exempt from liability, or the organization can not place the AED and do nothing else and be liability exempt.

I have just spoken with the Red Cross here in San Antonio, TX. They offer training in CPR, First Aid, and if requested use of and AED. The training meets OSHA standards for the workplace and will comply with the state's requirement of professional supervised training. I think that the best method of getting management "on board" is to look at the situation from their perspective and have good answers for their questions. All managers are human beings; they may need an AED as well as anybody else. Some more so, because of the pressure their position causes.

There are costs involved; both financial and legal. Well thought out solutions to the questions will make the transistion easier. Financial cost are in the range of $1500 to $2500 for one unit plus training (through the Red Cross) at $55 per person. Then there is lost work time or paid overtime if done not during a regular work shift. I am not saying that the financial cost is more important than the human cost. I am trying to show that management will always look at a cost benefit analysis. Manufacturing companies will always buy "the new machine" if its benefits exceed its costs. This must be true of an AED program.

I have called and asked them to pull this back and re-write it to encourage AED's in communities not discourage them. I hope others take the time to call... Glenda was very nice on the phone.
